Tactical Medics Group LLC Terms of Use, Privacy, and Messaging Terms
 

1) Acceptance of Terms

These Terms of Use (“Terms”) govern your access to and use of the Tactical Medics Group LLC website(s) and related online services (collectively, the “Site”), and any purchase or participation in Tactical Medics Group LLC (“TMG,” “we,” “us,” “our”) courses, products, and services.

By accessing the Site, registering, purchasing, or participating in any course, you agree to these Terms. If you do not agree, do not use the Site.

We may update these Terms from time to time. The “Effective Date” at the top of this page (or at the end) reflects the latest revision. Your continued use after changes means you accept the updated Terms.
 

2) Description of Services

TMG provides tactical medical education and training, including nationally recognized curricula and custom courses, as well as related materials and products. Course content, schedules, prerequisites, equipment lists, instructors, locations, and outlines may change at any time.

No medical or legal advice. Site and course content is educational and informational and is not medical direction, clinical care, legal advice, or a substitute for professional judgment, medical oversight, or agency policy.
 

3) Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to purchase a course or create an account unless a parent/guardian registers and signs any required waivers. You represent that you are legally able to enter into these Terms.
 

4) Personal Use; License; Restrictions

Unless otherwise stated in writing by TMG, the Site and its materials are provided for your personal and internal business use (e.g., to evaluate and purchase training, and for enrolled students to use course materials as permitted).

Except as expressly permitted by TMG in writing, you may not:

  • copy, reproduce, republish, upload, post, publicly display, transmit, distribute, sell, license, or create derivative works from Site content or course materials;

  • remove proprietary notices or branding;

  • use the Site for unlawful, harmful, or deceptive purposes; or

  • attempt to gain unauthorized access to accounts, systems, or networks.
     

5) Intellectual Property

TMG and/or its licensors own the Site design, logos, trademarks, and many of the text, graphics, videos, and course materials (the “Materials”). Some Materials may be owned by third parties and used under license, permission, or applicable legal doctrines.

TMG does not guarantee that every item displayed on the Site is free of third-party rights, and we do not warrant non-infringement. If you believe content on the Site infringes your rights, see the DMCA section below.
 

6) Accounts; Passwords; Security

If you create an account, you agree to provide accurate information and keep it current. You are responsible for maintaining the confidentiality of your credentials and for all activity under your account. Notify us promptly of suspected unauthorized use.

TMG is not responsible for losses caused by unauthorized access resulting from your failure to safeguard your credentials, to the maximum extent permitted by law.
 

7) Course Participation; Safety; Assumption of Risk

Many TMG courses involve hands-on skills, physical activity, training tools/props, simulated injuries, stress exposure, or environments that may involve inherent risks.

By enrolling and participating, you acknowledge and agree:

  • you are responsible for determining whether participation is appropriate for your health, fitness, and professional role;

  • you will follow instructor directions and safety rules;

  • you assume the inherent risks of training activities, except to the extent prohibited by law.

TMG may require additional waivers/releases for certain courses. If required, those documents are incorporated by reference.
 

8) Payments, Cancellations, and Refunds

If you purchase a course, product, or service, you agree to pay all applicable fees and taxes. Cancellation/refund terms may vary by course or contract and will be stated at checkout, on an invoice/statement of work, or in the applicable course policy. Where a written course policy conflicts with these Terms, the course policy controls for that purchase.
 

9) Third-Party Links

The Site may include links to third-party websites or services. TMG does not control and is not responsible for third-party content, policies, or practices. Links are provided for convenience and do not imply endorsement.
 

10) Privacy Notice

Information We Collect

We may collect information you provide directly (e.g., name, email, phone number, billing details, agency/company, course enrollment details), and we may also collect certain information automatically when you use the Site (e.g., IP address, approximate location, device identifiers, browser type, pages viewed, and usage data).

We may use cookies and similar technologies and may use third-party analytics/service providers that process data on our behalf.
 

How We Use Information

We use information to:

  • operate the Site and provide courses/services;

  • communicate about registrations, scheduling, updates, and customer support;

  • improve our offerings and Site performance;

  • comply with legal obligations and enforce these Terms.
     

How We Share Information

We do not sell your personal information. We may share information:

  • with vendors/service providers who help us operate (e.g., payment processors, email/SMS providers, analytics);

  • to comply with law, subpoenas, or lawful government requests;

THE SITE, MATERIALS, COURSES, AND ANY INFORMATION OR SERVICES PROVIDED ARE OFFERED ON AN “AS IS” AND “AS AVAILABLE” BASIS. TO THE MAXIMUM EXTENT PERMITTED BY LAW, TMG DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

TMG DOES NOT WARRANT THAT THE SITE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE; THAT DEFECTS WILL BE CORRECTED; OR THAT CONTENT IS COMPLETE, CURRENT, OR FREE OF ERRORS.
 

12) Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TMG WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE OR PARTICIPATION IN ANY COURSE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TMG’S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATED TO THE SITE, COURSES, OR THESE TERMS WILL NOT EXCEED THE AMOUNT YOU PAID TO TMG FOR THE SPECIFIC COURSE/PRODUCT/SERVICE GIVING RISE TO THE CLAIM IN THE 12 MONTHS BEFORE THE EVENT.

Some jurisdictions do not allow certain limitations, so some of these limits may not apply to you.
 

13) Indemnification

You agree to indemnify, defend, and hold harmless TMG and its owners, officers, directors, employees, contractors, and agents from and against claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising from or related to:

  • your violation of these Terms;

  • your misuse of the Site or Materials;

  • your violation of any law or third-party right; or

  • content you submit or post through the Site (if applicable).
     

14) Copyright (DMCA) Policy

If you believe in good faith that content on the Site infringes your U.S. copyright, you (or your agent) may send a notice requesting removal or disabling access.

A DMCA notice should include:

  1. your physical or electronic signature;

  2. identification of the copyrighted work claimed infringed;

  3. identification of the allegedly infringing material and enough information to locate it (URL preferred);

  4. your name, address, phone number, and email;

  5. a statement of good-faith belief the use is not authorized; and

  6. a statement, under penalty of perjury, that the information is accurate and you are authorized to act.
